Under the law, whenever a person signs an official document, the presumption is that they have accepted the contents of that document, and if they claim they were unaware of its contents, they must prove that claim.
If you intend to prepare a power of attorney for the transfer of property or immovable assets of high material value, or for an inheritance share, it is strongly recommended that you first consult with a licensed attorney inside the country, or with consular experts at the embassy, before preparing and signing the power of attorney.
By specifying the type and scope of the power of attorney and limiting the attorney's authority, you can prevent the attorney from overstepping or exceeding the scope set for them.

Preparing a Power of Attorney from Outside the Country

All Iranians residing abroad, including Iranians residing in the United States, must follow these steps to prepare a power of attorney from outside the country:

Go to the Consular Document Authentication (TAK) website and register on the site. Note that the information about you as the principal, as well as your attorney's information, must be complete and exactly match your Iranian birth certificate (shenasnameh). Choose a username and password for yourself.

After logging into the TAK system, go to the profile section and select the Iranian mission or consulate in the country where you live. For Iranians residing in the United States, you must select the option "Office for the Protection of the Interests of the Islamic Republic of Iran -- Washington." Go to the "Power of Attorney" section and select the type of power of attorney you want. Prepare and complete the power-of-attorney document. After confirming the text of the power of attorney, click the confirm button, and a tracking code will be given to you.

A Note for Iranians Residing Abroad Seeking a Divorce Decree in Iran

Before going to the embassy or the offices for the protection of interests, consult with our specialized senior attorneys in family law matters.
